Special Town Meeting

A Special Town Meeting of the electors and citizens qualified to vote in town meetings of the Town of Norfolk will be held at Town Hall on Thursday, March 3, 2016 at 7 p.m. Votes will be held on resolutions concerning pension benefits and the building code. SPECIAL TOWN MEETING

TOWN OF NORFOLK

 

A Special Town Meeting of the electors and citizens qualified to vote in town meetings of the Town of Norfolk, Connecticut will be held at the Norfolk Town Hall, 19 Maple Ave., Norfolk, CT 06058 on Thursday, March 3, 2016 at 7:00 PM for the following purpose

 

  1. To consider and act upon a resolution to amend the Code of the Town of Norfolk, Chapter 41, Pensions, Article V. §41-14, Payment of Benefits to add the following paragraph:

 

Effective March 1, 2016 through June 30, 2016, a terminated Member eligible for a Vested Deferred Benefit; which has not begun collecting their retirement benefit from the Town of Norfolk; is hereby eligible to elect a lump sum payment in cash, which is the Actuarial Equivalent of the Vested Deferred Benefit provided in Section 41-13 of the Code.

 

  1. To consider and act upon a resolution to amend the Code of the Town of Norfolk, Chapter 41, Pensions, Article V. §41-16; Options enumerated by adding the following option:
  2. Lump Sum Option: Effective January 1, 2016, a retiring Member may elect a one-time lump sum payment in cash, which is the Actuarial Equivalent of the Vested Deferred Benefit provided in Section 41-13 of the Code.

 

  1. To consider and act upon a resolution to amend the Code of the Town of Norfolk, Chapter 64, Building Construction, Article I. §64-2, Building permit fees as follows:

 

Eliminate the line; “There shall be a minimum application fee of $15.00 for any permit application”.

 

  1. The fees for building permits for the construction, alteration, removal and demolition of building and structures shall be at the rate established by the Building Official and approved by the Board of Selectmen.
  2. Before the issuance of a Certificate of Occupancy or Completion, with an estimate in excess of $50,000, the Building Official shall require the owner, agent or builder to furnish an affidavit showing the cost of the entire project and an additional permit fee shall be charged on the basis of any excess over the cost originally estimated upon the filing of the application.
  3. To be eliminated in its entirety and replaced as follows:

Pursuant to Connecticut General Statute §7-148(2)(b), the Building Official shall not issue a building permit to conduct work on any real property as to which there are outstanding delinquent sewer fees or taxes. Any person applying for a building permit shall present to the Building Official a written statement by the Tax Collector, on a form prescribed by the Tax Collector and Building Official, that the taxes on the real property which is the subject of the building permit application are either current or delinquent. If the Building Official does not receive such a statement within the time prescribed by law for deciding the building permit application, or if the certificate indicated that there are delinquent taxes on the property and the applicant fails to provide proof to the Building Official within said time that such delinquencies (including interest, liens, litigation expenses, and attorney’s fees, if applicable) have been paid in full, the Building Official shall deny the building permit application. Nothing in this section shall prohibit the Building Official from issuing a permit to perform repairs to an existing structure which is unsafe within the meaning of the State Building Code if the Building Official determines that such repairs should be performed immediately to protect the safety of either the building occupants or the public or if such repairs should be completed within the Connecticut Fire Safety Code as determined by the Fire Marshal.

 

  1. To consider and act upon a resolution to amend the Code of the Town of Norfolk, Chapter 64, Building Construction, Article II. §64-6, Farm Buildings and accessory structures to be eliminated in its entirety.
